Eligibility Criteria for the UK Global Talent Visa

Who Can Apply for a UK Global Talent Visa

Individuals can apply for UK Global Talent Visa if they have an endorsement to prove they are leaders in their respective fields. To be considered for entry under the Global Talent visa for the UK, individuals are typically required to seek endorsement from one of the six endorsing bodies authorized by the UK Home Office. For applicants seeking endorsement in the fields of science, engineering, medicine, social sciences, humanities, or other academic and research roles, the Home Office will refer their application to either the British Academy, Royal Academy of Engineering, Royal Society, or UK Research and Innovation (UKRI). These organizations will evaluate the evidence provided and make a decision regarding the endorsement. 

On the other hand, applicants seeking endorsement in non-academic fields such as arts and culture and digital technology will have their applications referred to either Arts Council England or Tech Nation. These organizations follow distinct endorsement criteria. Once the endorsement is granted, the final decision regarding immigration lies with the Home Office. Holders of certain prestigious prizes have the option to apply for a UK Global Talent visa without undergoing the initial endorsement stage. 

Application Process for the UK Global Talent Visa

Researchers seeking endorsement for a UK Global Talent visa have four available routes to obtain their endorsement: 

1. Academic and Research Appointments: This route offers fast-track endorsement to individuals who have accepted a qualifying position at an approved UK higher education institution or research institute. The position must involve academic, research, or innovation leadership and development or directing or leading an individual or team research or innovation project/program. The British Academy, the Royal Academy of Engineering, and the Royal Society administer this route. 
2. Individual Fellowships: This fast-track endorsement is available to individuals awarded an individual fellowship from the approved list of fellowships by the British Academy, Royal Academy of Engineering, and the Royal Society. The fellowship should be currently held or have been held within the last five years. 
3. Endorsed Funders: Researchers and specialists can benefit from fast-track endorsement if their name or job title is specified in a successful grant application from an endorsed funder approved by UK Research and Innovation (UKRI). To be eligible, researchers must be hosted or employed by an eligible institution approved by UKRI. 
4. Peer Review: This is the standard endorsement route, where individuals submit an application for full peer review by the British Academy, Royal Academy of Engineering, or Royal Society. 

For the endorsed funders route, UKRI (UK Research and Innovation) accepts applications from any academic or research discipline. However, for the remaining three routes, researchers must select the endorsing body that aligns with their specific field of research. The British Academy assesses applications from the humanities and social sciences, the Royal Academy of Engineering covers engineering, and the Royal Society focuses on the natural and medical sciences. 

Processing Time for the UK Global Talent Visa

The processing time for a UK Global Talent visa is three weeks if the applicant is applying from the United Kingdom. Otherwise, it is eight weeks if the applicant is applying outside the UK. 

Validity and Renewal of the UK Global Talent Visa

Individuals under the UK Global Talent visa can live and work in the United Kingdom for up to 5 years. For those who wish to stay longer in the UK, there is no specific limit on the total duration of their stay. However, the visa must be renewed (or " extended ") before expiration. Each extension can range from 1 to 5 years, allowing the individual to choose the desired duration. 

Depending on the field of work and the application process followed it may be possible to obtain indefinite leave to remain after 3 or 5 years. It allows individuals to settle in the UK, granting them the right to live, work, and study there for as long as they desire. Additionally, eligible individuals can apply for benefits. 

Dependants of UK Global Talent Visa Holders

In the context of the UK Global Talent visa, a ’dependant’ refers to individuals who fall into one of the following categories: 

1. Spouse, husband, wife, civil partner, or unmarried partner of the visa holder. 
2. Children under 18, including those born in the UK during the visa holder’s stay. 
3. Children over the age of 18 who are currently residing in the UK as dependents of the visa holder. 

The dependents of the UK Global Talent visa holders are subject to several conditions: 

1. They are not entitled to receive public funds. 
2. They are allowed to pursue studies in the UK. However, certain courses may necessitate an ATAS certificate before commencing studies.
3. The dependent of the UK Global Talent visa holder is permitted to work in the United Kingdom, excluding roles as a sportsperson or sports coach.

2. Recognition of the Global nature of Research and Innovation: With the Global Talent visa for the United Kingdom, individuals are free to travel anywhere for research purposes without absences counting towards the maximum time permitted away from the UK if they decide to apply for settlement. 
3. Establishing a long-term Connection to the UK: The UK Global Talent visa offers significant advantages for individuals seeking a lasting connection with the United Kingdom. These benefits include a fast-track option for settlement after three years for the primary visa holder and, if applicable, the opportunity for close family members to work in the UK. 

Advantages of the Global Talent Visa

Once an individual is endorsed for the UK Global Talent visa, subject to criminality and immigration checks, they can enjoy a range of benefits: 

1. Flexible Work Arrangements: The UK Global Talent visa offers a work visa that is highly flexible, with no restrictions on salary, working hours, or location. Visa holders have the freedom to take unpaid leave, sabbaticals, engage in secondary work, or provide consultancy services. 
2. Independent Visa Duration: Unlike other visas tied to specific employment contracts, fellowships, or grant periods, the UK Global Talent visa allows individuals to choose the length of their visa, with a maximum duration of up to 5 years. 
3. Expedited Settlement Process: The main visa holder can benefit from a fast-track option for settlement, also known as indefinite leave to remain, after three years, instead of the typical 5-year period. 
4. No Requirement for a Confirmed Job Offer: Unlike other visa categories, the Global Talent visa for the UK does not necessitate a confirmed job offer in the United Kingdom. 
5. No Sponsor Duties: No obligations or responsibilities are imposed on sponsors for UK Global Talent visa holders. 
6. Exemptions from Certain Requirements: The UK Global Talent visa does not require applicants to meet English language proficiency or maintenance requirements during the visa application process. Additionally, there is no requirement for an Academic Technology Approval Scheme (ATAS) certificate. 

However, it is important to note that the administrative burden lies with the applicant, and certain endorsement routes, especially those involving peer review, do not guarantee a positive outcome. Additionally, preparing the endorsement application may take some time. 

Switching to the UK Global Talent Visa

Individuals may be able to switch to a Global Talent Visa from within the UK, provided they do not possess permission to remain in the country through any of the visa routes mentioned below:

Disadvantages of the UK Global Talent Visa

The sole drawback of the UK Global Talent Visa lies in the fact that the administrative burden rests upon the applicant. For certain endorsement routes, there is no assurance of a definite outcome, particularly in cases involving peer review. Additionally, it might require significant time to prepare the endorsement application adequately. 

Alternatives to the UK Global Talent Visa

If an applicant is ineligible for a Global Talent visa for the UK, alternative avenues exist to work in the United Kingdom, including applying for a Skilled Worker visa.

A Skilled Worker visa permits individuals to come to or remain in the UK for the purpose of engaging in an eligible job with an approved licensed sponsor. 

Difference Between the Global Talent Visa and the Tier 1 Exceptional Talent Visa

The Government enacted the introduction of the UK Global Talent visa on 30 January 2020. The category took effect on 20 February 2020. The new Global Talent visa replaced the Tier 1 (Exceptional Talent) visa for candidates applying post-20 February 2020. Meanwhile, the Tier 1 Exceptional Talent route remains open exclusively for ILR applications. 

The Global Talent visa for the UK resembles its precursor, the Tier 1 Exceptional Talent visa. Labeling Global Talent as an entirely new route would be somewhat unfair. Instead, it represents a simplification and expansion of the existing rules. To apply for a UK visa under the Global Talent route is no longer a part of Part 6A of the Immigration Rules. Instead, it has been incorporated into Appendix W (W signifying "work"), paralleling the Innovator and Start-up routes. It is no longer points-based and does not fall under Tier 1. 

There are five key differences between the Tier 1 (Exceptional Talent) and the new UK Global Talent visa category: 

1. Absence of a Cap: Unlike Tier 1 (Exceptional Talent), the Global Talent Visa category operates without a cap. Considering that the endorsement limit each Tier 1 (Exceptional Talent) endorsing body could make was never reached, this alteration isn’t expected to have a significant impact. 
2. Addition of a New Endorsing Body: UK Research and Innovation (UKRI) is a new addition to the list of endorsing bodies. UKRI reviews applications from scientific community members who will be hosted or employed at an acknowledged UK research organization. 
3. Easing of Absences for Research: Endorsed Global Talent applicants from the fields of science, engineering, humanities, and medicine can engage in overseas research directly related to their UK visa without the absence being ’counted’ in an application for indefinite leave to remain. 
4. Accelerated Path to Settlement: Endorsees from the fields of science, engineering, humanities, and medicine now have the possibility to apply for indefinite leave to remain after three years. This applies irrespective of whether their visa was granted for "exceptional promise" or "exceptional talent." 
5. No Inclusion in the Points Based System (PBS): Mirroring the Start-up and Innovator visa categories introduced in the previous year, the UK Global Talent visa rules have now been included in Appendix W. They are no longer officially part of Tier 1 of the PBS. 

Future Prospects of the UK Global Talent Visa

On 31 January 2023, Tech Nation announced that it would halt operations on 31 March 2023 due to the UK Government’s decision to reassign the Digital Growth Grant of 12.09m Pound Sterling, a significant portion of Tech Nation’s funding, to Barclays Eagle Labs. This situation led to considerable doubt regarding the digital technology component of the UK Global Talent route’s future. 

Although the Home Office asserted its commitment to the continuation of this route, no replacement endorsing body or endorsement procedure was revealed. No additional details were provided on 31 March 2023, when Tech Nation terminated its operations. Nearly a month later, on 25 April 2023, the Home Office finally disclosed that Tech Nation had been incorporated into the Founders Forum Group. They also affirmed that the current process for seeking endorsement as a digital technology application for a UK Global Talent visa remains the same, with the Tech Nation still applicable. Nevertheless, a more permanent solution for the procedure is being developed by the Home Office. Interested applicants are advised to check with the embassy and keep track of the news on the latest developments.
